These Terms of Service ("Terms") govern your use of the XpertsPortal website at xpertsportal.com and any services we provide. By using our website or engaging our services, you agree to these Terms. If you do not agree, do not use our website or services.
By accessing our website, submitting an inquiry, requesting an evaluation, applying to our evaluator network, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy.
XpertsPortal is an independent expert and academic mentor matching service. We coordinate the introduction and engagement of credentialed third-party professionals ("Experts" or "Evaluators") with clients seeking their services. We are not the provider of the underlying professional service.
Engagements are between the client and the retained expert. XpertsPortal handles intake, matching, conflict checks, scheduling, and engagement coordination. The substantive professional work — testimony, evaluation, valuation, mentorship, or report — is performed by the independent expert under their own professional license, standards, and judgment.
XpertsPortal is not a law firm and does not provide legal advice, legal opinions, or representation. We are not a medical provider and do not provide diagnoses or treatment. We are not a financial advisor and do not provide investment, tax, or financial planning advice. We are not a college or university and do not control admissions decisions.
Information provided through our website, intake forms, or general communications is for informational purposes only. For advice specific to your matter, consult a qualified licensed professional.
When you select an expert through our service:
Conflict checks are conducted before introductions. If a conflict is identified after engagement begins, the expert will withdraw and we will assist with a replacement match.
Pricing displayed on our website represents starting estimates. Actual fees depend on case complexity, scope, jurisdiction, expert specialty, and engagement length. A complete fee schedule is provided in writing before any engagement begins.
Fees may include: matching coordination fee, expert retainer, hourly rates for preparation and testimony or evaluation work, travel expenses, and rush fees for expedited timelines. Payment terms, refund policies, and cancellation conditions are specified in the engagement agreement signed with each retained expert.
By using our service, you agree to:

For litigation engagements, similar principles apply: we do not guarantee case outcomes, settlement amounts, or admissibility rulings. Court and jury decisions are outside the control of any expert or service provider.

Reports, evaluations, and creative work produced by experts during an engagement are governed by the engagement agreement signed with the expert and applicable professional ethics rules.
We treat client matter information as confidential and use it only to facilitate the matching and engagement process. See our Privacy Policy for details on information handling. You should not transmit privileged or highly sensitive material through unsecured channels; encrypted communication is available on request.
Our website and matching service are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, secure, or error-free, or that any matched expert will produce a particular result.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, XpertsPortal, its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, or from any expert engagement coordinated through our service.
Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount of fees paid directly to XpertsPortal (excluding amounts paid to retained experts) in the twelve months preceding the claim.
You agree to indemnify and hold harmless XpertsPortal, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your breach of these Terms, your interactions with retained experts, or your violation of any law or third-party rights.

Upon termination, the provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of state and federal courts located in Alameda County, California, except as set forth in section 16.
